Banning Jaswant Singh Book 'Jinnah – India, Partition, Independence' Is Violation of Fundamental Right

The Narendra Modi Government had banned the book 'Jinnah - India, Partition, Independence' written by Jaswant Singh, on August 19 saying the book might create communal disturbances in the state and was also derogatory of India’s first Home Minister of India, Sardar Vallabhai Patel.

In response BJP leader & former minister of finance, defense and external affairs Jaswant Singh had filed a petition in the Supreme Court challenging the Gujarat government decision. 

Senior advocates Fali S Nariman and Soli Sorabjee, appeared for the veteran politician and publisher of the book, Rupa and Company and contended that banning of the book was violative of fundamental rights of its author and publisher. They sought preponment of hearing from September 11 contending that "it was not a bonafide attempt to ban the book" by Gujarat government as it violates the fundamental rights of speech and expression guaranteed under Article 19 (1)(A) of the Constitution.

But on September 4th the Gujarat High Court on Friday revoked the ban and said that the Government’s decision was violating the fundamental rights and freedom of expression. The bench of judges, on the PIL, said the notification banning the book lacked “thinking” and “understanding”. They also said that it might have been issued without reading or comprehending the book’s contents.
